EU Online Withdrawal Function on Shopify: Requirements from June 19, 2026
Direct answer: from June 19, 2026, Italy applies the new Article 54-bis of the Consumer Code to distance contracts concluded through an online interface after that date. Where the right of withdrawal applies, the trader must also allow the consumer to exercise it through an online withdrawal function that is visible, easily accessible and available throughout the period in which the right can be exercised.
What Article 54-bis requires
Legislative Decree No. 209 of December 31, 2025, implementing Directive (EU) 2023/2673, introduces Article 54-bis into the Italian Consumer Code. The function must be identified with an unambiguous wording equivalent to “withdraw from the contract here”.
The online statement must let the consumer easily provide or confirm at least their name, information identifying the contract and the electronic means on which they want to receive confirmation.
The second step: confirming withdrawal
After completing the statement, the consumer must be able to submit it through a confirmation function identified by an unambiguous wording equivalent to “confirm withdrawal”. After confirmation, the trader must send an acknowledgement without undue delay on a durable medium, including the content and the date and time of submission.
What the rule does not say
I do not present the absence of the function as automatically equivalent to a specific fine or to a twelve-month extension of the withdrawal period. The Consumer Code provides different consequences depending on the obligation breached and the information actually provided to the consumer. Assessing the legal risk for an individual merchant requires legal analysis, not a commercial claim.
How to implement it on Shopify
The technical implementation can use a function integrated into the theme, an app or another flow compatible with the store, provided the final behavior meets the applicable requirements. What needs to be tested is not the technology name but the actual workflow: accessibility, required data, confirmation, acknowledgement and traceability.
