ART. 1 – DATA CONTROLLER
The Data Controller for the personal data collected through the website www.ifgecommerce.com is the sole proprietorship IFG eCommerce® by Francesco Guiducci, with registered office at Via Giacinto Pullino 72, 00154 Rome (RM), Italy, VAT No. IT16879681001. For any communication regarding data protection and the exercise of rights provided by the GDPR, the data subject may contact the Controller exclusively at the email address: info@ifgecommerce.com.
ART. 2 – TYPES OF PERSONAL DATA PROCESSED
The Controller processes identification and contact data (name, surname, email) voluntarily provided by the user during the purchase or contact phase. Furthermore, it processes tax and invoicing data necessary for the purchase of Digital Products and Professional Services. Navigation data (IP addresses, system logs) and online identifiers are also collected via cookies, which are necessary for the provision of services on the Shopify platform and for the analysis of the Site's performance.
ART. 3 – PURPOSES AND LEGAL BASIS FOR PROCESSING
Processing is aimed at the execution of contractual obligations arising from the sale of digital content and professional services (Art. 6.1.b GDPR), the fulfillment of legal and tax obligations (Art. 6.1.c GDPR), and, subject to explicit consent, the sending of technical newsletters and updates on the IFG Protocol (Art. 6.1.a GDPR). The Controller also processes data for the legitimate interest of Site security and fraud prevention (Art. 6.1.f GDPR).
ART. 4 – PROCESSING METHODS AND DATA SECURITY
Processing is carried out using computer and electronic tools in compliance with the Zero-Friction security standards adopted by the Controller. Strict technical and organizational measures are implemented to prevent data loss, illicit or incorrect use, and unauthorized access. Logs related to professional consulting and software development are protected by encryption and restrictive access procedures.
ART. 5 – DATA RETENTION
Tax and contractual data are stored for 10 years, in compliance with Italian legal obligations. Data collected for marketing purposes are stored for a maximum period of 24 months from the last active interaction with the Customer or until consent is withdrawn. Technical data relating to cookies have a variable duration as defined in the extended Cookie Policy accessible via the dedicated widget.
ART. 6 – DATA COMMUNICATION AND INTERNATIONAL TRANSFERS
The data will never be disclosed to unspecified parties. They may be communicated to technical partners (e.g., Shopify Inc.), tax consultants, credit institutions, and judicial authorities. Should these entities reside outside the EEA (European Economic Area), the transfer takes place exclusively on the basis of Adequacy Decisions or through the signing of the European Commission's Standard Contractual Clauses (SCC).
ART. 7 – RIGHTS OF THE DATA SUBJECT (ART. 15-22 GDPR)
Users have the right to request from the Controller access to their data, rectification, erasure (right to be forgotten), restriction of processing, or to object to the processing, as well as the right to data portability. Any request must be sent to info@ifgecommerce.com. If the user believes that the processing violates the GDPR, they have the right to lodge a complaint with the Data Protection Authority (Garante per la Protezione dei Dati Personali).
ART. 8 – DEFINITION AND FUNCTION OF COOKIES
Cookies are small text strings that websites visited by the user send to their terminal, where they are stored to be transmitted back to the same sites upon the next visit. This Site uses cookies to improve the user experience, manage the shopping cart for Digital Products, and monitor traffic in aggregate form through analytical technologies.
ART. 9 – COOKIE MANAGEMENT VIA IUBENDA
The Site utilizes the solution provided by Iubenda for managing cookies, the consent registry, and user preferences. Iubenda acts as a technical provider to ensure compliance with the ePrivacy Directive and the GDPR. Through the banner and the Iubenda widget present on the Site, the user can view the full and updated list of cookies used, categorized by type and provider, and exercise their right to opt-in or opt-out in a granular manner.
ART. 10 – COOKIE CATEGORIES AND DISABLING
The Site uses: 1) Technical Cookies (Essential): necessary for the proper functioning of Shopify and the Academy area. 2) Analytical Cookies: used for statistics (e.g., Google Analytics 4) with anonymized IP. 3) Marketing Cookies: installed only upon prior consent via the Iubenda banner. The user can also disable cookies at any time by changing their browser settings (Chrome, Safari, Firefox, Edge), aware that this may compromise checkout functionalities.
ART. 11 – TRADE SECRETS AND TECHNICAL DATA
Data relating to technical traces, custom Liquid codes, or optimization methodologies exchanged during professional services are protected as trade secrets and are the exclusive property of Francesco Guiducci. Such data cannot be subject to access requests under the GDPR if this would result in the disclosure of the Controller's technical and commercial know-how.
ART. 12 – AMENDMENTS TO THE POLICY
The Controller reserves the right to modify this Privacy and Cookie Policy at any time to adapt it to regulatory or technological changes. The version published on the Site is the current one. Users are invited to periodically consult the "last updated" date at the top of the document.
